Why You Deserve Compensation
You’ve been paying your superannuation contributions faithfully for years, usually including insurance premiums through your fund. Now that you’ve been injured, the last thing you should have to worry about is whether your claim will be accepted. The insurance system is designed to help you when you need it most, but unfortunately, insurers linked to super funds often make it hard for you to get the compensation you’re contractually entitled to.
This is where we come in. As experienced personal injury lawyers, we are dedicated to helping people like you navigate the complex claims process and ensure you receive a fair payout. We will fight on your behalf to make sure that the insurer does what they’re supposed to do – pay you what you’re owed.
Super Funds & TPD Insurers: Unfair Denials
Superannuation funds and their Total and Permanent Disability (TPD) insurers are notorious for denying claims unfairly. They often use loopholes, delay tactics, and technicalities to avoid paying out, even if you’re entitled to compensation. Some common tactics include:
- Claiming your injury isn’t severe enough to qualify for compensation.
- Delaying the claims process indefinitely with excessive paperwork requests.
- Refusing to acknowledge that your injury is covered under your policy.
- Sending you to doctors for medical reports that will downplay the severity of your injury.
These practices are unethical and can leave you without the support you need in a time of crisis. But you don’t have to accept it. Our team is here to ensure that you get the payout you deserve. We’ll handle the legal side, so you can focus on your recovery.

What is TPD insurance?
‘TPD’ stands for Total and Permanent Disability. Most good superannuation funds include TPD insurance as part of the policy – you might not even know you are covered. A total and permanent disability claim entitles you to payment of a lump sum if you have suffered an injury or illness that prevents you from returning to work in the same capacity that you were performing before the injury/illness.
This means that you do not have to be catastrophically injured to make a claim.
Most personal injuries which impact your ability to work are caused by motor vehicle accidents, or workplace accidents. However even a slip and fall in a public place can cause serious injuries.
TPD insurance cover usually ranges from around $50,000 – $2,000,000. The coverage amount typically decreases as you get older. The cover is for current and future medical costs, to clear any debts that you’re not able to pay for anymore since you stopped work and provides you with a source of income to replace the income you’re no longer receiving.

What type of injuries can I make a claim for?
TPD insurance can potentially cover any kind of injury, even if it seems minor.
For example – Roche Legal have been successful claiming TPD benefits for clients who suffered:
- a fractured ankle from a motorcycle accident
- a back injury from lifting something heavy at work
- a neck injury from slipping over in a public place
- a psychological injury from witnessing a traumatic event
It generally doesn’t matter who caused your injuries or how they occurred, so long as the injury wasn’t intentionally self-inflicted. The injury must be serious enough that it impacts your ability to work. For example, an injury that causes you to only be able to work part-time rather than full-time.
An injury that is insignificant in nature is typically one that you are expected to make a full recovery from without any complications whatsoever, with a full return to work as usual.
What % of my compensation payout do I have to pay in legal fees?
Roche Legal does not charge a percentage of your compensation amount.
We charge fixed fees for all TPD claims and only once your claim is successful. On average, our fixed fees typically work out to be around 10-15% of the TPD insurance value. The insurance value is determined by the cover contained in your superannuation policy.
Unlike other law firms, we do not charge an uplift on TPD Claims. Our quoted fixed fee is exactly that – fixed, with no surprises.
